Eviction Process:
- The landlord must serve a written notice of eviction to the tenant, which will be done by a Sheriff's Deputy or Constable. If served by the Daviess County Sheriff's Office, they will also provide a typed copy of the notice.
- The tenant has 30 days from the date of service to vacate the premises.
- If the tenant fails to vacate within 30 days, the landlord must file for an eviction hearing at the Small Claims Office on the second floor of the Judicial Center.
- Both the landlord and the tenant will receive a Notice of Eviction Hearing, requiring their appearance before a judge on the specified court date.
- If the tenant still does not vacate as ordered by the judge, the property owner must file for a Writ of Possession at the Small Claims Office in the Judicial Center.
- The Writ of Possession must be served by a Sheriff's Deputy or Constable.
